Why PATH will NEVER happen

1/9/2011

Just in case having their motion to toll accepted in West Virginia on Friday swelled some heads at PATH, here's a list of all the problems PATH still faces.  These problems add up into one HUGE mountain that PATH is still trying to climb.  Every time they inch forward a bit, they slide back toward the bottom a little more by the appearance of new problems.  Kind of reminds me of a kid's board game.

1.  Maryland and Virginia still have not acted on PATH's motion to toll.  Anything can happen.  If anything less than having their wishes granted in both states occurs, this will have an effect on the process in the other two states. If this happens, PATH may have to return to Start.

2.  Their project has no end point.  Frederick County has turned down their applications for approval of their gigantic substation.  Next step is for PATH to fight this through the courts.  That could take a long, long time.  Miss at least two turns.

3.  The EIS process.  Because PATH crosses federal land, an Environmental Impact Statement must be prepared and approvals granted to PATH to cross this federal land.  This process takes years.  The original target date for this process to conclude was fall of 2012.  However, the process is currently stalled with the Park Service having to replace the contractor helping with the process.  Add months to the approval process.  Miss three turns.

4.  PATH's 14.3% ROE is being questioned at FERC.  A re-hearing is currently in process and a new ROE will be set for the project.  It won't be 14.3%.  And they're probably going to have to refund part of the profit they have already collected since the initial approval was only conditional.  Pay a penalty.

5.  PATH's public image is in the trashcan.  There's nothing they can do about it either!  The opposition's PR machine is much more ROBUST than PATH's because it relies on FACTS and the TRUTH.  Once a person knows the truth, there's nothing PATH can do to change their mind.  Everyone hates you, PATH!  Lose 10 turns.

6.  PATH has become politically unpopular.  Because of the huge public opposition to this project, politicians are no longer in favor of it.  They want votes, not bribes from PATH.  Go back 50 spaces.

The original WV-PSC decision date in West Virginia was to have been June 21, 2010.  If not for all the citizen opposition, PATH would have quietly been approved and would be under construction right now.  This is the reason we fight and will continue to do so.  PATH's opposition continues to grow every day, while its supporters dwindle.

Have I forgotten anything?  If I've omitted something that belongs on this list, let me know.

PATH can't win this game.

Oooh! Oooh! I can add a few!

7. The longer this drags out, the more state and national energy policies change. Just look at the stuff New Jersey is doing, and how the federal government is trying to streamline its offshore wind application processes!

8. The longer this drags out (get the theme here?), the more alternatives are emerging - not just offshore wind, but the likelihood of Google's offshore backbone, and the reality of Dominion's Alternative 1.

9. You don't mention the HUGE problems this is causing PJM. Talk about trying to get us to "ignore the man behind the curtain!" PJM has been shown to be intellectually dishonest and biased, and its "stakeholders," to use the business term du jour, are beginning to rebel. Let's see - the consumer advocates in its territory, many of the member companies, many of the PSCs or whatever they're called in each state (such as Missouri!) ...

This is a fun game! Let's see if we can grow this list!

10. Despite PJM’s initial claims in PATH applications in MD, East VA and WV that electricity demand was rising dramatically into the foreseeable future, PJM has consistently reduced demand projections every year since the PATH applications were prepared. Last year, PJM’s “experts” guaranteed an economic recovery that would restore their demand predictions. Just last week, their most recent demand estimate reduction was based in part on no economic recovery through 2016.

AHAHAHAHAHAHAHAH!! There goes #1! PATH needs to return to START!

Virginia denied PATH's motion to toll. The Virginia case is going to continue on the current schedule with the current application.

Gosh, all those decision dates are now seriously out of whack... do you suppose PATH will need to file another motion in WV to untoll the case so that those schedules can coincide? Afterall, it was so important it needed to be used as a reason to toll before.....

Only thing I don't like about this is being forced to spend my b-day with these jerks over in Va.

Keryn, lucky you have the inside scoop as I have been checking the SCC's website all day and nothing has been posted. Hurray for VA, they seem to get things right. Hey, last year, you spent your birthday with us in CT, guess you'll get to spend it with some of us again this year only in VA.

WAY TO GO VIRGINIA FOLKS! YOUR VOICES HAVE BEEN HEARD! Way to go Virginia SCC! You have listened to your citizens! If PATH has any positive reason for this STOOOOPID project, they now get the oppertunity to present it. HAHAHAHAHAHAHA! Now instead of asking for a "do-over", as we have seen several times in Maryland, we get to wait for an "un-do" in West Virginia? I had a horrible Monday at work today but to come home to this news brightens my whole day. Why you may ask?... because I know PATH DOESN'T HAVE A CASE! And I can just imagine what Randy's office is like right about now ... lots of screaming, scrambling, blaming, crying and whining, etc ... and don't forget Todd lookin' like a shameful lil sorority chick with his "daddy issues." HAHAHAHAHA!
As for your birthday Keryn, you won't be spending it with "jerks" in Virginia, you'll be spending it with new friends thanks to PATH. Hard to believe there IS a silver lining to all this madness, we have all met and made new friends as a result of PATH! "Business as usual" no longer exsits PATH! I bet we find a frothy glass of Arrogant Bastard somewhere in Virginia as well. PATH, I think it's time for you to take you ball and go home. I'm tired of your "game" but I will play longer than you do!

Actually, we got snowed out of last year's b-day events if I remember correctly, and they got delayed by a month. At any rate, ALL the company was pleasant at that gathering. Not a big deal though... PATH is one of Pavlov's dogs and in this situation reflex tells them to beg for withdrawal. I'll just go ahead and make other plans :-)

My bad, yes, I guess that was in March. All I know is that I gave up sweets for Lent and couldn't partake of the wonderful cake that was there.

Is my b-day before lent this year? Just to be on the safe side, give up something else this year.... like answering the phone when land agents call. ;-)

Lent begins March 9. Easter is very late this year. You know, those pesky land agents have not tried to call me back nor have they come knocking on my door. I'm going to love being the last holdout in my neighborhood and really make them squirm.

$$$$$$

If you have to move, might as well buy your own island somewhere in the South Pacific after you retire. I'll come visit every winter.

I guess your name is on PATH's "Naughty List", Pam.

    StopPATH Blog

StopPATH Blog began as a forum for information and opinion about the PATH transmission project.  The PATH project was abandoned in 2012, however, this blog was not.

StopPATH Blog continues to bring you energy policy news and opinion from a consumer's point of view.  If it's sometimes snarky and oftentimes irreverent, just remember that the truth isn't pretty.  People come here because they want the truth, instead of the usual dreadful lies this industry continues to tell itself.  If you keep reading, I'll keep writing.
