PATH front groups continue at ratepayer expense

3/14/2011

Seems like it was just the other day that we were discussing American Electric Power and FirstEnergy's inclusion of ratepayer funding of their PATH front groups as one of those "activities necessary to maintain the project in its current state" during their "suspension" of the project.

Of course they are continuing the front groups at YOUR expense, electric ratepayer!

See this op-ed in The Baltimore Sun.  Dan Ervin of ShoreENERGY tells us that even though PJM has "suspended" PATH due to lack of need for the project, the power companies should build it anyhow.  In his fantasy world, everyone is supposed to lean on the Maryland Public Service Commission and somehow the project will happen just like magic!

Who is Dan Ervin?  He's a "member of Marylanders for Reliable Power."  What is Marylanders for Reliable Power?  It's PATH's ratepayer-funded Maryland front group.  Ervin is happily spewing power company propaganda for a "coalition" that exists only on the internet, in the American Electric Power and FirstEnergy board rooms, and in the offices of PATH's public relations contractors.  Marylanders for Reliable Power is a scam being perpetrated on both their members, who are unaware of where all the funding for their activities comes from; and on the millions of ratepayers in the PJM region who fund the "coalition", including Maryland electric customers!

As revealed in the Formal Challenge to Potomac-Appalachian Transmission Highline, LLC 2010 Formula Rate Annual Update (beginning on page 9), filed at FERC on January 21, 2011, these front groups are a PATH propaganda tool.  PATH spent $682,048.66 on their three state front groups in 2009.  The "coalitions" are not standalone legal entities; they do not legally exist as registered entities and therefore all financing of their activities comes directly from PATH.  PATH in turn recovers their costs for these front groups from YOU in your electric bill.

The truth behind Marylanders for Reliable Power and the other front group "coalitions" was revealed in Exhibit-P of the Formal Challenge.  Exhibit-P consists of PATH's purchase orders and contracts with The Artemis Group, who pulls the puppet strings on guys like Ervin on a daily basis; and Charles Ryan Associates, who "supervises" The Artemis Group in return for a healthy chunk of change every month.  CRA also maintains the Marylanders for Reliable Power website.

Who does PATH think they're fooling at this point?  And why is the funding of a front group "necessary to maintain the project in its current state"?  The exorbitantly expensive and unnecessary propaganda and influence buying campaign continues!

Here's a task for our friends in Maryland (or any other fan of the truth, no matter where you live).  Respond to Ervin, The Artemis Group, Charles Ryan Associates and PATH by writing your own op-ed about this farce and submitting it to the Baltimore Sun.

Just when I think PATH can't get any stupider, they continue to amaze me.

Just last week there was an article in the Journal saying more and more West Virginians cannot pay their electric bills due to the economy, unemployment, rate increases, etc. I can't believe any of these people have a conscience and how do they sleep at night knowing people are having their electric turned off because of all of the above plus other reasons. The rate increases is what really gets my gall since I know a lot of money is going to these useless "groups" on PATH's payroll. The old saying, "What goes around, comes around." I can only hope that someday that will apply to PATH and all their cronies.

Note that this Ervin dude is from Salisbury, MD on the eastern shore. Do you think PHI (PEPCO Holdings, Inc.) the parent company of Delmarva Power, which wants to build the MAPP line, is shoveling money to Ervin?

While Ervin mentions PJM's rejection of PATH, his main focus seems to be on how that will affect MAPP.

Thanks for connecting Ervin to your findings in the FERC case. I'm sure our friends on the Eastern Shore who are fighting MAPP will appreciate the information.

No, I don't think PEPCO is in on it. There is a clear money trail from Marylanders for Reliable Power to PATH.... direct to your electric bill! The "coalitions" were created by PATH and have been funded by PATH. Although, if someone wants to question Artemis about where they get their funding to carry on this charade, it might be kind of interesting.

MAPP only gets a mention -- we don't know how this will affect MAPP -- and then he launches back into PATH.

Funny that Mr. Ervin doesn't mention the biggest transmission upgrade in the region that is moving very rapidly to approval and construction, the rebuilding of Mt. Storm to Doubs, MD which resolves most of PJM's "reliability" problems.

You'd think he would be pushing this project if he really wanted to improve our transmission system.

I think he just wants to improve the "transmission system" that takes money out of my pocket as an electric customer and "transmits" it into his own pocket as a paid front man for PATH's front group.

Sorry for putting this comment here but didn't know where else to put it. Please read E. Michael Teter's response to PATH's motion to dismiss on the VA SCC website. Are we, in WV, in that same predicament since it was dismissed in our state without prejudice. We will still be held hostage for several years, having to disclose to potential buyers of our property that at some point in time this may come back. I know we all have targets on our backs and I'm sure realtors in the area know who we are. Our PSC was in such a hurry to get the monkey off their backs, they allowed no time for anyone to responde and to make any kind of argument. And I don't know know if anyone can answer to this or not, but one of my neighbors on the road below me, gave an option to PATH for his property and then suddenly passed away last week. Do you know what will happen to his property?

Two issues -- first regarding disclosure -- that's probably a matter of WV law that would best be answered by a realtor. I will ask one I know (you know her too!) LOL

As far as your neighbor, he has just passed the PATH option onto his heirs. That's the way their option is written. Now whoever inherits his property is bound by what he signed with PATH. If his heirs would be multiple children who are supposed to split the estate, good luck! They'll never be able to sell that property to liquidate assets and they're all going to be bound to it until the option expires or is exercised. This means that they're responsible for taxes, fees, assessments as owners of the property. And.... if PATH finds an "environmental condition" (undefined) on the property, the heirs are responsible for the costs of mitigating it. PATH also has the right to enter onto the property and pretty much do whatever they want while they are there.

This is a nightmare for the heirs. (read more on the Landowner Resources page and to see a copy of one of PATH's options).

PATH continues to screw people even after they die!

Thanks, Keryn, for your insight. AS far as I know, he had no children, wasn't married. I'll keep you posted as to activity around that property.

Someone must be in line to inherit, but if I was them, I'd run away as fast as I could, change my name, leave the country... Inheriting a property under PATH option is like inheriting herpes.

WOW! What a nightmare Pam. Someone has to inherit that property and the poor person(s) that does get to inheit the nightmare as well. This is why we tried so hard to talk to folks early on about all the smoke and mirrors the land agents were presenting.
Indeed Keryn, PATH is continuing to screw people even after death.
This is precisely why PATH has to be killed for good never, never to come back!

Unlike we intend to do with PATH, Herpes NEVER goes away, it's only treatable! PATH WILL GO AWAY! Inheriting the nightmare of a PATH optioned property is far worse than Herpes.

StopPATH Blog began as a forum for information and opinion about the PATH transmission project.  The PATH project was abandoned in 2012, however, this blog was not.

StopPATH Blog continues to bring you energy policy news and opinion from a consumer's point of view.  If it's sometimes snarky and oftentimes irreverent, just remember that the truth isn't pretty.  People come here because they want the truth, instead of the usual dreadful lies this industry continues to tell itself.  If you keep reading, I'll keep writing.
