Haverty wins motion to compel!

Sometimes, it's just not your day -- PATH seems to be having a lot of those lately.  Today definitely wasn't their day either.

In an order issued today, WV intervenor Ali Haverty was granted her motion to compel.  This means that PATH will have to produce:

"For account 426.1 please provide recipient, amount given, and purpose of the donation."

"For account 426.4 please provide recipient, amount given, and purpose of the expenditure."

You know PATH, you don't have to go down in complete humiliation. You have a choice! Yes you do. http://www.ferc.gov/enforcement/self-reports.asp

you know what they say....admitting you have a problem is the first step on the road to recovery.
it is time that PATH start giving serious consideration to playing c-y-a in preparation for the hoops they are going to have to jump through to recover prudently incurred costs for a project that is abandoned due to factors beyond their control. except this kind of stuff probably would not qualify. the failure of PATH is nobody's fault but their own.

"Oh what a tangled web we weve when first we practice to decieve." Well thanks to some very dillegent work, on behalf of ratepayers everywhere, it seems as if PATH will have to open their books for all to see. Admittedly not voluntarily and with crowbar like prying but open non-the-less. If Allegheny and friends have been shafting us on this project, just imagine how much we have been $cr#@d out of over the past. Business as usual will be no longer and it's because some citizens have stood up and said enough is enough! Now, I have no problem with a business making FAIR profit on a product or service that I am buying but we have seen over and over, there is nothing FAIR about this. First, I have NO CHOICE as to where to buy my electric (except for "going off the grid" and I'm working on that one). Second, there is absolutely nothing fair about 14.3% R.O.E. And third, IT IS UNCONSTITUTIONAL TO TAKE MY PROPERTY BY "EMINANT DOMAIN" BY A PRIVATE COMPANY FOR PROFIT!

Maryland now has a choice in CAKES land. Windpower for just a few cents a KW hour more. Its spreading like wildfire. And just wanted to bring something up. Seems like Todd Myers has been droning on the statement that PATH will cost 85 cents a month on each bill so many times, that the dumb MD reporters believe it. The real cost is exactly one of the questions they have to answer at the MD PSC so the 85 cents is an outright lie. If it exists in press releases by PATH, I have another word for it. F-R-A-U-D. (Isn't that a criminal offense?)

Hi Hill. You hit on something important. Unfortunately, a CT case that went to the Supreme CT has torn some serious holes in the ability of private companies to get eminent domain power for economic interest -- very sad case. Whatdya say we work to turn THAT one around? I'm game. I think that opinion is a bit too general and needs some refinement -- like when the private interest is crooked and not answerable to any public transparency requirements. More on that later. Yes PATH, we think BIG!!!

Ken Ward hates it whenever I bring this up, but ... Why have only a couple of WV media outlets, namely the Martinsburg Journal and the Weston Democrat, picked up this important story?

The press release on it has been out for almost 3 weeks.

It's a story that affects every single rate payer in the state, not to mention PJM.

Where's the coverage? And why is no one covering this?

85 cents a month per maryland customer MINIMUM for eternity isn't chump change. Other ratepayers (51 million of them) are also going to be paying comparable monthly fees for PATH. Imagine the pile of coins that makes each month for PATH. This monthly increase is based on PATH's expected yearly revenue requirement and isn't quite as big a lie as the $2.1B price tag. That one is a complete perversion of fact. $2.1B is the cost of land and fixtures ONLY, and does not take into account a whole host of other costs such as O&M, taxes, etc. It's like buying a new car for $29.95 and upon signing the papers finding out that they have added in a ton of other costs. How many have been hit with that after making a deal on a car and then ended up financing several thousand more when all those "small print" but necessary items are added in on the final paperwork? $2.1B is a HUGE lie.

We're going to have us some fun with PATH's cost claims at the state regulatory hearings :-)

I have been completely amazed at how many brains snap shut at the mention of accounting. It's like I just asked them to understand some form of advanced calculus. It's not that hard, folks!!

Don't worry, they're not all like that :-) There are a few gems out there that I'm busy polishing. It takes a long time to create the perfect stone but I'm confident we're going to get there.

Exactly David! Just clarification on the Supreme Court case from CT. It is problematic for Citizens and helpful to corporations seeking eminent domain. Sorry if that was confusing. It is on the radar for many Constitutionalists and local rule believers. PATH would be a perfect antidote for a slew of reasons - including how it is harmful to the environment and people -- which could negate any purported public economic interest that justifies the Court's loosey goosey private eminent domain giveaway. Wouldn't it be poetic justice if PATH were responsible for ruining the sandbox so carefully crafted be generations of utility giants? More sibling dysfunction! So keep working folks. Issues that you may not think are central at this level have to stay alive in the record because they could come up later.

That lil Smegal fellar sure is U-G-L-Y! I bet R.P. kinda looks the same these days. Pacin' round the office, wringing his hands, snapping at his minions ... HURRAY 4 the commissioners! I wonder if they are just as curious as everyone else 2 see whos taking the bribes or maybe they just want to clear their own names from being on the list. if they had denied it there always would be that question.........

We've been referring to this as "the precious" for a long, long time because the pit bull was guarding it so intensely. He should have figured out by now that "no" is never a proper answer :-)
