Appalachian Power Customers Find Out How They Were Lied To By The Company, The PSC and Their Elected Officials

"I told you so" is never as satisfying as it sounds.

Back in 2012, Appalachian Power proposed legislation that would allow the company to mortgage all its old, unrecovered fuel and other debts so that it could cash out and leave its customers with a long-term monthly mortgage obligation.  Appalachian Power called this amazing "no rate increase" magic trick "Consumer Rate Relief Bonds."

The legislature and the PSC embraced APCo's rate relief magic because it gave them cover to pretend they had averted a 30 - 40% rate increase for APCo customers.

The measure was approved by the legislature, and the PSC has since approved the bond sale.  Appalachian Power has now been made whole for the outrageous costs it paid for coal to fuel its power plants in 2009.

However, APCo customers have finally been handed the bill, and they're not happy.
Lynn Pugh opened her AEP bill this month to see just how much the cold January had set her back, but she found something in her bill that she normally doesn’t see.

“I’ve never seen the consumer rate relief charge,” said AEP customer Lynn Pugh.

Starting in December of 2013, AEP began adding the consumer rate relief charge to customer bills. According to the company, the new charge is a way to help them account for the spike in the price of coal in 2008-2009.

“It’s actually a reflection of a settlement we had with the PSC to recover the cost of coal,” said AEP spokesman Phillip Moye.

Normally AEP pays around $50 per ton for coal, but in ’08 and ’09 they were paying over $100 per ton because of a coal shortage.

The Public Service Commission signed off on the charge and has allowed AEP to keep it on your bill for the next 15 years. Pugh was shocked to learn that the charge would be on her bill for the next 15 years.

Moye said the AEP opted to go with the additional charge rather than increasing the rate on the price of power.

“The impact on the rate would have been tremendous,” Moye said. “30 to 40 percent increase, and that obviously is more than what customers can bare.”   [bear!!  although maybe customers will tear off their clothes and run naked through the legislature in protest?]

Pugh said she understands why she is paying the additional charge, but doesn’t think it should be on there for the next 15 years.

“I can’t imagine that they paid that much extra for coal that every AEP customer is going to have to pay this.”

The charge is based on how much your bill costs. Pugh’s charge was almost 11 dollars.
Ms. Pugh is only beginning to understand that now, in addition to all the old coal debt, she's also paying for other deferred regulatory assets, plus interest and fees.

We tried to stop this craziness in 2012, but customers like Ms. Pugh weren't paying any attention and took no interest in helping themselves.  If Ms. Pugh had known then what she knows now, might she have picked up the phone and called her elected representative, or dashed off an email to the PSC?  Probably.

Now APCo customers have the next 15 years to lament their lack of consumer education.  When will West Virginia fund an effective consumer advocacy program that includes public education?  Or does our legislature prefer us to remain barefoot, pregnant and chained to the coal-fired power station?

We have a lot of work to do, West Virginia!

But now the price of coal is rock bottom. Why not petition the public service commission to adjust the consumer relief fee to a negative number to account for the sweet prices APCO is paying now. Sauce for the goose and all of that rot.

I echo what Nathaniel Mullins posted. I have emailed the PSC in the past when AEP wanted to raised our rates to no avail. The utilities have no incentive to run their company within a budget., It seems as though the PSC is on the side of the utilities.

Maybe more of the public in West Virginia would be more attentive to their bills if a large portion of them weren't on public assistance. A lot of their bills are paid for through the government anyway. They probably don't really care what the amount of their bill is since it's taken care of anyway.

The Bible says,talk that you know and testify what youhave seen. This is not true that the government pays a large portion of the bills. The government only pays a portion. One has to come up with sum of the money, after the DHHR pays for some, if one qualifies. Many agencies only pay a portion, but one has to have the majority of the money themselves. Unless, you walk in other peoples shoes, stop judging, and going by what you heard. Right now, WV is going through a terrible hardship because of the high electric bills that AEP has inflicted on us during the month of Dec 2016. We only had a cold snap. Hundreds of dollars have been added to the bills, that people do not owe. People have had to borrow money, pawn, go to some agencies, that give them little or nothing. Some have been without electricity. Stop judging, unless you want to walk in other shoes. I would like to see what you have to say, if you are ever in a predicament like some of these people. One man just told me that he paid 500. 00 on his bill, got an extension , still owe 700.00, and have to pay 250.00 deposit, because he was late paying. He has a 91 yr old mother-in-law, and wife in wheelchair. May be without lights for 7 days before his check comes to pay it. He said, I can't believe they would cut someone's lights off with a 90 yr old, and someone in wheelchair. If you can't use your life to help people , then superglue your tongue and shut up. The Bible says : the tongue is an unruly evil that no man came tame. To find these scriptures, please use google, and it will tell you where to read it. All this can do is help you. 3-22-2017.

Patricia, I agree with everything that you have said ESPECIALLY about Decembers power bill. I even sent the PSC am email that I had done nothing different, the weather had been mild but my bill still doubled. I attributed it to the fact that APCO assumes everyone has lighted Christmas decorations so the automatically double their bills. It's shameful

You say it like those that pay there bills with NO help owe others to take up the slack. I'm not wealthy. We get by. We work, pay our bills, and get no help from anyone. I see many that don't even try to work and get hand outs right and left on the backs of those that will work and pay their bills. The ones that pay their bills forgo many wants and wishes only to see those getting preferential treatment and handouts get everything they want and more.
I don't go on vacations every year, buy new cell phones every time one comes out, buys a new car (Puts it under someone else's name to avoid being caught), smoke cigarettes, buy liquor, buy new clothes all the time, get my hair and nails done, keep having babies I can't afford, don't work, and yet complain they can't make it. No, I don't owe those types of people anything. So if you want to push that stuff around, I'm telling you what I've known and seen. It isn't always as you put it. There are many out here that aren't even trying. Pure laziness because things get handed to them. There are only a few amount of people that truly need help. A good portion are moochers.
There are some that truly do need help. So that's fine if you want to help people, but how about glue your mouth shut and keep your hands out of my wallet. I wouldn't be surprised of you are one of those riding the system, but spewing your bible. It's called theft if you can't work and make no effort. No one owes you a free ride.

I looked up this Consumer Rate Relief Charge to find out exactly what it is and regrettably kept scrolling down to where I see comments. How does an article about the said topic go from giving a helpful explanation to what it actually is, to people bringing God and your neighbors and how lazy people are,and how others work but do without the so called finer things in life. It's just sad to see people tear into one another claiming their point of view is the right one. How did we go from the consumer rate relief charge to that. Just ridiculous the way you people and your opinions are.

Thats exactly what i was doing Amanda. I wanted to know what the CRRC was and ended up reading about judgement, people putting their 2 cents in where it doesnt belong and not minding their own. I dont understand why people cant stay on topic either.

I want to know if the falling coal prices are going to level all this out and do away with this much sooner than later. Or are the prices allowing nothing but profit for dividend holders. Nothing seems to come back down once it goes up. I feel taken advantage of more and more often.

No, Beth, unfortunately the consumer rate relief charge will be on your bill for 10 years, until the debt is retired. The charge is nothing more than a fancy utility mortgage that you have to pay until it is paid in full. In 2009, Appalachian Power ended up on the wrong side of some coal contracts and paid outrageous costs for coal it burned to power people's homes in 2009. The company and the PSC kept putting those costs aside because they didn't want to raise rates that much in one year. However, the company was still earning interest on that amount as long as it was unpaid. In 2012, they could put it off no longer, so they came up with a scheme to borrow money to pay Appalachian Power off and retire that debt. APCO got its money, and its customers get to repay the bank who fronted up the money, plus interest, over the next 10 years. To make bad even worse, APCO tossed in a bunch of other debts hanging around on the ol' balance sheet into the mix and borrowed to satisfy that debt too. It's a horrible idea but unfortunately APCO customers are stuck with it now. It's kind of like the company took out a mortgage in the current customer's name to pay for electricity that someone else used back in 2009. Dumb and sneaky, but that's how the WV PSC operates when nobody is paying attention.

The name Public Service Commision is a very misleading name,there needs to be some kind of accountability to the public. We need to have our legislators to sponsor a bill to run a check on their personal checking accounts.There really needs to be a way to keep them honest,then they wouldn't want the job. Election is coming up,and we need to make a house cleaning. Every election counts.

Coal use is only a front. AEP has been weening itself off coal for years because of Obama and emissions requirements. Leftist AEP bought right in....They spent billions converting to gas and ditching coal...don't believe the BS about coal costs. It's paying for all the new cross over equipment.
