Gosh, I wonder what kind of shenanigans they're going to find? No, actually I don't, I have a really good imagination :-) Happy New Year, FE!

Well its about time! I bet the Office of Enforcement knew there was trouble there since around.....uh....maybe...May of 2010 when they purportedly toughened up their enforcement mechanisms. Wonder if Randy may have underestimated the power of pissed off ratepayers long before he bothered with their existence let alone imagined they could be a force to be reckoned with. Ahhhh...Memory Lane where consumer enforcement started out on a very determined stroll and ended up leaving a massive energy giant befuddled and vulnerable in places it didn't even know were under attack. Ouch!

I've been sooooo busy over the last few days, I almost missed out on the fun. WHAAAAANDY? I agree, FERC is simply vexatious and burdonsome and should be listed as "not a party of interest." However, this party seems to be getting better and better every day. Strike up the band. Arrogance and the blowhards have been warming up for a while now. Now ... I think I hear the fat lady singin. I doubt it very much bit I would bet a big ol slice of humble pie is about to be served as well. HAHAHAHAHAHAHAHAHAHAHAHAHAHAHA

The fun part of this process is that if the auditee wants to contest specific findings, they have to bring the contest out into the sunshine and interested parties can file briefs. The other fun part is the office of enforcement has god-like power and can get stuff like emails. Wonder what Mr. Palmer discussed. Ya think the investigators might wanna run a keyword search for the word "Keryn" ? Oh yes...another fun part....they are developing a forensic auditing tool. Any rush to deletion or tampering will backfire and nail down the coffin. Here is my bet...Trailco does its damdest to settle asap to end the pain and keep the bloody mess from going public. My advice to FERC...clean their clocks. You have them by the short and curlies. After all, we have a national debt to pay off and I can't think of a more appropriate underwriter. My advice to all the landowners ripped off in the big land grab...see a lawyer to think about filing a suit for harm done. Heck, file it pro se and they will have no choice but to defend the case by claiming some technical reason to throw it out, but in the meantime, remember lawsuits are public records and they may just be much more interested in a fair or generous settlement then they were before. In fact, wonder if a multiplicity of lawsuits would increase the likelihood of a big settlement. Can anyone say "class action"? Not much fun for the defendant with an active audit going on. And don't let anyone talk you out of anything because statutes of limitations ran. If you are claiming fraud for example and the coverup is still going on, its a continuing fraud and that issue alone can get some hot face time with a judge. Wow, do we deserve to have such fun? Hell yeah!

I'm just havin me way too much fun. Here's my next scenario. The attorney general of WV takes TrailCo on with a consumer protection lawsuit on behalf of WV ratepayers and landowners. In terms of state government, that could be an opportunity to shed the bonds of pay-off politics. With a massive settlement for ratepayers, y'all in state government can click the refresh button and get yourselves a whole new cast of characters for your circles of influence.
