Frederick Co. Maryland Board of Zoning Appeals Hearing

UPDATE:  The continuation of the hearing has been scheduled for Thursday, October 14 at 7:00 p.m. at Winchester Hall in Frederick.  PATH still has two witnesses to present, so if you'd like an opportunity to question their paid witnesses, here's your chance!  You will also have the opportunity for general public comment.

Last night we attended what has turned out to be the first session of the Frederick County Board of Zoning Appeals hearing on PATH's application for a special exception to build their monstrosity, or "death site" as one of the many citizens dubbed it.

Despite beginning at 1:00 p.m. and being allotted two hours to present their case, PATH still wasn't done at 11:30 p.m. last night.  At least one additional session for this hearing will be scheduled to allow PATH to finish presenting their case, to allow the opposition groups to present their case, and to allow for general public comment.

The Board of Zoning Appeals did an outstanding job managing the process, even when presented with a crowd who was at times rebellious.  This hearing is a legal process and courtroom behavior should prevail.  As illogical as it certainly is, the BZA can only rule on the substation itself, and not other components of the PATH project.  It is correct (in the abstract) that the substation could be approved and built under BZA authority without any lines ever connected to it.  If you think that would actually happen though, don't.  Just play along, folks!  This decision has to be able to withstand future legal scrutiny because it will surely be challenged, no matter how the case is decided.

What was really fun about last night was that the public was allowed to cross-examine PATH's witnesses.  We sat through Linda Erdreich (EMF health effects "expert"), James Silva (EMF engineer) and some other guy who was supposed to be an "expert" in noise effects from the substation (I can't remember his name).  It was amusing to watch the witnesses continually pass the buck onto the next witness in line when they couldn't or didn't want to answer a question.  Other amusements:  Watching the witnesses struggle along once they were off their script.  Not the most personable bunch you'd want to invite to your next dinner party!  Watching them squirm over some of the excellent questions they were asked by the public. And then there is the opponent who is just plain funny -- this guy cracks me up every time.  Last night his "death site" comment had me wiping my eyes trying to maintain some composure.  The best part by far though was watching one of their witnesses commit perjury.  :-)  Ouchies!

When we get word of the date & time of the continuation of this hearing, we'll let you know.  Until then, the decision in Frederick County is still up in the air.

In fairness to PATH's noble efforts, I want to clarify. The PATH was given two hours to present its case, but it was on a timer WITHOUT any cross examination - they speak - and the timer stops when they have to face the people's questioning. Frederick County MD has really got a handle on this democracy thing. Every time the People in the PATH case have been in a situation where they have a Constitutionally guaranteed right to speak, they have been provided that opportunity to fully excersize that right -- even if it is awfully gruelling. The Maryland PSC hearing officer seems like he could go there too -- we HOPE.

In any event, we have a very resilient group of people here who will withstand the many many hours of everything required of citizens who participate with their actions -- not just moronic complaints. (Keryn, you have GOT to talk about news story on-line commenters!) Isn't it just grand when democratic principles actually have a chance against money and influence? Our "death site" guy, a fearless "Old Country" immigrant like my dad, can be a pain, but he just revels in the wonders of this great country where you don't get killed or tortured for your opinions.

Sorry for the self-indulgent soapbox. Everyone should understand that these marathon-citizen-power-sessions we are entitled to are gruelling, painful, sleep-depriving, emotion-wracking, timecard-and-budget-killing, family- angering events with no guaranteed results. BUT everyone should try it sometime. You will either come out invigorated with power and possibility or questioning whether its all worth it, or both. That's the part that can come with tears of frustration. But when is the last time you have had an opportunity to come face to face with your values?

Umm... being everywhere? Kind of makes me sound like the hand of God or something. Maybe I need to take some time off?

I have actually missed a few things :-)

I'll think about the commenters, but I feel myself getting dumber if I contemplate them too long.

You don't get tortured or killed for your opinions about PATH. You just get hauled out of a public meeting by moonlighting cops for expressing them. Not my idea of free speech PATH..........you bastards!

To be clear, no one was thrown out of this public hearing. I think Cindy is referring to PATH's "Open House" held the week before.

they have come out of the wood work with there 4 wheelers here on grapevine_pigeon roost sissonville kanahwa county area road doing the suveying we are the only people who are not letting them on there property why? why are they doing this without psc go ahead getting surrounded feeling a little creeped out anyone have any suggestions or can help us?we welcome anything!

Debra - Call the cops -- in case you don't trust the locals, call the FBI as backup. Is ther a highway patrol? Call your state attorney general and go up the ladder as far as you can. The broader you broadcast your reports, the better, and do it simultaneously. No reason citizens should have to get creeped out by a company who pretends they have government authority to creep. I don't remember voting for anyone in charge of this kind of operation. Do you? You pay taxes for the government to take an interest, I suggest you use it.
